Introduction

These Terms and Conditions (Terms) apply to your use of the Hither software and any related services (Services) provided by Hither (Company, we, us, our). By accessing, using, or registering an account with our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services. If you are using our Services on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

Access and Use of Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services solely for your personal educational and preparatory purposes. You may not use the Services for any other purpose without our prior consent.

Intellectual Property Rights

All intellectual property rights in and to the Services, including but not limited to copyrights, trademarks, patents, and trade secrets, are owned by the Company and/or its licensors. Except for the limited license granted in Section 2, these Terms do not grant you any rights to use or access any intellectual property rights in the Services.

User Content

You are solely responsible for any content, including but not limited to text, images, audio, video, and other materials (User Content), that you create, submit, post, or display using the Services. By submitting User Content, you represent and warrant that you have all necessary rights and permissions to do so and that your User Content does not infringe any third-party rights, including but not limited to copyrights, trademarks, and rights of privacy or publicity.

You grant the Company a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your User Content in connection with the Services and the Company's business, including for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or resources. You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or resources.

Termination

We may terminate your access to and use of the Services, at our sole discretion, at any time and without notice to you. You may also terminate your access to and use of the Services at any time by closing your account and discontinuing your use of the Services. Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Any provisions of these Terms that, by their nature, should survive termination shall survive termination, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

Disclaimer of Warranties

The Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company does not warrant that the Services will be uninterrupted, error-free, or completely secure, or that any defects or errors will be corrected.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall the Company, its affiliates, or their respective officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Changes to these Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes to these Terms by posting the updated Terms on our website or by notifying you through the Services. By continuing to access or use the Services after any changes become effective, you agree to be bound by the revised Terms.

Google Account Handling

If you choose to link or sign in to Hither using your Google Account, you grant us permission to access and use certain Google Account information, including but not limited to your Google email address and public profile information. Hither may access, store, and use this information in accordance with our Privacy Policy to create and manage your account, provide services to you, and verify your access to our services.

By linking your Google Account, you understand that Hither will have ongoing access to limited information from your Google Account such as basic profile, email address, and profile picture in order to provide the services. Hither does not have access to your Google Account password and will not manage your Google Account.

You have the ability to unlink your Google Account from our services at any time. To do this, you must adjust your Google Account settings directly. If you unlink your Google Account, Hither will not have access to your Google Account information unless you choose to link it again in the future.

Please note that your relationship with Google is governed by Google's terms and conditions, including its privacy policy. Hither is not responsible for any changes made to your Google Account by Google, any dispute between you and Google, or any act or omission by Google.
